All countries are striving to improve the business climate in order to contribute to the economic and social prosperity of their people, and Morocco, like other countries, has made efforts to achieve this, including by modernizing the arsenal in the field of business.

However, the process of criminal follow-up of economic crimes still falls under the jurisdiction of the courts of first instance, which constitutes an obstacle to the achievement of economic security and the encouragement of investments.

Therefore, the introduction of the idea of specialization in the criminal field has become necessary with the attribution of competence to the commercial courts to examine economic crimes, because of their experience in the commercial field.

On the other hand, it is necessary to think about reformulating the corporate criminal law, on the basis of restricting criminal interference to a minimum and surrounding the intervention with effective constitutional oversight, on the horizon of rationalizing the process of punitive measures to protect the business climate and encourage investments.
