The concept of delegation of public utilities is a new concept for an old relationship.

French doctrine and jurisprudence has been contributed to its development.

It has been adopted by the Algerian law in several legal texts.

However, it only appeared as a full system in the presidential decree no° 15/247 related to Public procurement contracts, public utility' delegations and the executive decree no0 18/199, related to the delegation of territorial collectivities utilities.

For the first time, it carried a separate legal framework distinct from that of the regulation of Public procurement contracts, based on restrictions and procedures that aimed to make the optimal choice of the delegate, which reflects positively on the process of effectiveness
