The following article attends to the problematic arising from the phenomenon or a situation known in Islamic Shari’a laws as “common sense”; that is that which is widely-in-circulation or simply “famous” but to which applies no direct law or a clear cut ‘fatwa’.

The field where the “common sensical” applies has been ever since the start of Islam a fertile domain for debate and reflection.

In this connection, it is interesting to note that the way early Muslim jurisprudents define, classify and judge “common sense” does not necessarily oblige late jurisprudents in anyway.

Hence the critical importance of that fragile space created as a result of the potential that ‘common sense’ makes possible in the first place.
