مبدأ عدم الجمع بين الوظائف مكرس لحماية الحرية الفردية و هو مقرر لضمان حسن سير الدعوى الجزائية باعتباره المبدأ الذي يضبط تقسيم الوظائف بين مختلف الجهات القضائية الفاعلة في الدعوى (متابعة تحقيق حكم تنفيذ) بهدف ضمان عدم التحيز و تجسيد جوهر الحياد بمفهومه الموضوعي.

و لكن تثار إشكالية حديثة بخصوص تعارض الجمع بين الوظائف و الحريات الفردية غير أننا عند مقارنة وظيفة التنفيذ العقابي بباقي وظائف القضاء الجزائي (المتابعة التحقيق الحكم) خاصة عند محاولة قاضي تطبيق العقوبات تعديل مضمون الحكم أو القرار بإصدار بعض المقررات (إجازة الخروج التوقيف المؤقت لتطبيق العقوبة الإفراج المشروط) أو محاولة تعديل حدود الجزاء (تعديل التدبير الأمني أو إلغائه من طرف قاضي الحكم أو تحديد قاضي تطبيق العقوبات لتاريخ انتهائه) نجدها لا تتأثر بمبدأ الفصل بين وظائف القضاء الجزائي إلا بقدر يسير و مع ذلك نجد نظرية عدم الجمع متجسدة وفقا لعدة حالات و فرضيات.

The principle of not gathering functions is set up for protecting the individual freedom, it ensures the good conduct of penal case, as it is the principle dividing the functions between the different efficient judiciary authorities in the case (The pursuit, instruction, Judgment, Execution) in order to ensure no biasing and embodying the essence of impartiality in its subjective concept.

However a recent polemic is raised about the opposition of gathering functions and the individual freedoms, At the comparison of the function of punitive execution to the other criminal functions (Pursuit, instruction, Judgment) especially when the sentence enforcement judge tries to amend the content of the judgment or the decision by issuing some decisions (release license, temporary suspension of the application of sanction, conditional liberation; "parole") or trying to amend the sanction limits (amending or canceling the security measure by the judge, or determining the date of its expiration by the sentence enforcement judge ) we find that it is slightly affected by the principle of separating the functions of the criminal Judiciary, although we find out that the theory of gathering is incarnated according to many cases and theses.

Le principe de non cumul des fonctions est consacré pour la protection de la liberté individuelle, il est établi pour garantir la bonne marche de l'instance pénale, étant le principe qui régule la répartition des fonctions entre les différentes instances judiciaires actives dans l'affaire (poursuite, enquête, jugement, exécution) afin d'assurer de ne pas prendre parti dans son concept subjectif.

Toutefois, une polémique récente surgit concernant le conflit entre les fonctions et les libertés individuelles, mais quand nous avons comparé la fonction de l'exécution pénale avec les autres fonctions de la justice pénale (poursuite, enquête, jugement) notamment lors de la tentative du juge d'exécution des peines de modifier le contenu du jugement ou rendre certains arrêtés (permis de sortir, arrestation temporaire pour l'exécution de la peine, la liberté conditionnelle) ou la tentative de modifier les limites de la sanction (modifier ou annuler la mesure sécuritaire par le juge, ou la fixation par le juge d'exécution des peine la date de sa fin) nous la trouvons peu affectée par le principe de séparation entre les fonctions de la justice pénale, néanmoins nous trouvons la théorie de non cumul incarnée selon plusieurs cas et hypothèses.
