التجارة من أكثر القطاعات استجابة للتقدم التكنولوجي و أوسعها إستخداما للتقنيات الحديثة و المتطورة هذه الأخيرة تعد محور تحول تجاري نتج عنه تغير عميق في سلوك المتعاملين و في قواعد المعاملات التجارية حيث ظهر نوع جديد من المبادلات التجارية اصطلح عليه بالتجارة الإلكترونية أفرزته شبكة التواصل الاجتماعي و وفرت له الوسائل الخاصة به و التي تتناسب مع طبيعته و أضحت هذه الشبكة سوقا وطنية و دولية إفتراضية غير عادية نظرا لما تمتاز به التجارة الإلكترونية من المردود الحسن و الفعال و اختصارا للوقت وتوفيرا في التكاليف.
و من بين أدوات التجارة الإلكترونية تلك العقود التي تبرم عبر الوسائط الإلكترونية عن بعد و التي تدعى بالعقود الإلكترونية و طرفاها هما المستهلك و المتدخل الإلكتروني

Trade sector is one of the most responsive to technological advances, And the most extensive use of modern technologies and sophisticated, the latter is the axis of a trade transformation, resulted in a profound change in the behavior of dealers and in the rules of commercial transactions, where the emergence of a new type of trade, called the electronic commerce, created by the social network and provided him with the means of his own and commensurate with the nature.
This network has become a national and international virtual market, In view of the good and effective benefits of e-commerce, shortening time and saving costs.
Among the tools of e-commerce are those contracts that are concluded via electronic media remotely, which are called e-contracts and their parties are consumer and electronic intermediary.

Le commerce est l’un des plus secteurs réactifs aux avancées technologiques, Et l'utilisation la plus extensive des technologies modernes et sophistiquées, ce dernier est l'axe d'une transformation du commerce, entraîné un changement profond dans le comportement des concessionnaires et dans les règles des transactions commerciales, d'où l'émergence d'un nouveau type de commerce, appelé commerce électronique, créé par le réseau social et lui fournissant les moyens propres et adaptés à la nature.
Ce réseau est devenu un marché virtuel national et international, compte tenu des avantages positifs et efficaces du commerce électronique, de la réduction des délais et de la réduction des coûts.
Parmi les outils du commerce électronique figurent les contrats conclus à distance via des supports électroniques, appelés contrats électroniques, dont les parties sont des consommateurs et des intermédiaires électroniques.
