Most European constitutional courts and councils have demonstrated their distinct role in the field of human rights and fundamental freedoms and in monitoring the legislature's commitment to achieving the balance between rights and freedoms on one side and the public interest on the other side.

This paper examines the role of the Algerian Constitutional Council in the protection of rights and freedoms by analyzing its decisions and opinions in this regard, as part of its control of the constitutionality of laws and its remoteness from the shell of parliamentary rationality to the role currently known protectionist role.
