Abstract EN

This study deals with the reality of endowment (Waqfs) between Malikite and Hanafi School in Algeria by the end of the Ottoman era.

As it is well known that the phenomenon of endowments (waqfs) has been widely known in the dependency of Algerian society, this phenomenon also witnessed a great development and organization throughout the Ottoman presence in Algeria, which made it play a distinctive role in maintaining the integrity and cohesion of Algerian society.

Considering that Algeria was known, during the era of the Ottoman, two doctrines in Islamic jurisprudence which are the Malikite school and the Hanafi school, so their points of view on the endowments (waqfs) have remained different, especially according to the Self- endowment (waqf), this has made many Malikites Algerian prefer to use endowments (waqfs) of their property under the provisions of the Hanafi school, to materialize a kind of coexistence of doctrine in the field of endowments (waqfs) in Algeria during the Ottoman era.
