جائحة كورونا و أثرها على عقود العمل قوة قاهرة أم ظرف طارئ : (دراسة مقارنة بين التشريعين الجزائري و الفرنسي)‎

Abstract EN

The aim of this study is to highlight the impact of the Corona pandemic on the work contract, as a mutually binding contract.

Unlike the Algerian legislator, his French counterpart in labour law has mentioned force majeure as one of the reasons for the termination of such contract.

In this context, if the pandemic is considered as a case of force majeure, this can lead to the annulment of the work contract without compensation or notice.

However, considering it as an emergency circumstance opens the possibility for the judge to modify the contract in order to remove the fatigue effect on the injured part.
