Penal order is one from many forms of the system of conviction without pleading.

It is one of the most important alternatives to the public prosecution that relies on the idea of simplifying and shortening procedures in resolving simple cases and avoiding the accumulation of cases before criminal courts.

As in comparative legislation, Algerian law has adopted this system for its advantages in the amendment of criminal procedure code under the Order 15/02.

Although this system lacks fair trial guarantees related to adversarial principle, these practical flaws didn't stand up to the requirements of judicial process; especially since the legislator gave the accused the right to object the penal order and then to be tried according to the ordinary trial procedures.
