In Islam, the fatherhood relation is assigned to the father based on the conjugal relationship, and motherhood is assigned by procreation or delivery.

This when the birth is natural from an official marriage and a normal sexual relationship between the wife and the husband.

However, the modern techniques for the artificial fertilizing have evoked new questions regarding the parentage of the child to both father's and mother's sides.

The problem becomes more complicated, especially when a foreign element is involved in the fertilizing or the procreation processes.

Because of the importance of the subjectm this paper tries to answer those open questions and investigates the judgments regarding a baby born as a result of an artificial fertilizing.
