In order to ensure the effectiveness of established international legal standards for the protection of cultural heritage against violations, it was decided to impose a dual responsibility, this responsibility not being limited only to States required to return cultural property.

That were acquired in armed conflict or during the occupation with compensation of affected countries, but which can extend to natural persons, especially since the individual often breaks the cultural heritage in several ways, the fundamental problem here was the degree of guarantee of international conventions on international and individual criminal responsibility for violations of cultural heritage.

In spite of all the care given to the cultural heritage, the warring countries continue to this day to destroy these monuments and historic buildings and escape all responsibility under the pretext of military necessity on the basis of which the cultural identity of the occupied State has been destroyed.
