Abstract EN

Medical Damage is an essential component of medical responsibility.

In view of this importance, the Algerian legislator sought to control the legal framework on the subject and defined the responsibilities according to the type of the damage, its criteria, the cause and consequences of the injury and distinguished between its quality of the medical responsibilities.

The first, concerning the treating physician's responsibility in his personal capacity, and the second, on the general hospital as a public facility.

We have reached a set of results concerning to the ambiguity of the legal foundations, the basis of medical responsibility and the ence of training specialized judicial training of the administrative judge which did not keep up with contemporary medical developments
