اشتملت هذه الأوراق البحثية عدة مباحث متمثلة في مفهوم قاعدة: "لا إنكار في مسائل الخلاف" ببيان صيغها ومعناها، ثم أنواع الخلاف في الشريعة أصولها وفروعها، والآثار المترتبة عليها، كما اشتملت على أعذار المجتهدين المؤهلين مع أسباب اختلافهم، ثم بيان العلاقة بين هذه القاعدة وقاعدة "لا إنكار في مسائل الاجتهاد"، على غرار قواعد الاجتهاد الأخرى كقاعدة مراعاة الخلاف، ونقض الاجتهاد وحكم الحاكم في رفع الخلاف، وغيرها، ثم ذكر مسألة كون الخلاف رحمة وسعة أم لا، ثم ختم البحث بنتائج جامعة لما استفيد من القاعدة من ضوابط وفروق وآثار نظرية وأخرى عملية.
Abstract EN
These research papers included several topics: represented in: the concept of a rule: “no denial in issues of disagreement” by explaining its formulas and its meaning, then the types of disagreement in origins and branches, and the implications thereof.
then he mentioned the issue of the disagreement mercy and ampleness, or not, then concluded the research with comprehensive results of what benefited from the rule in terms of controls, differences, and theoretical and practical implications.
