Algerian laws, like the comparative statutory legislation, concerned the family system, foremost among which is the constitution, which stipulates in Article 58 of it that the family enjoys the protection of the state and society, and the family law, civil status law, and civil law also contain rules for organizing and building the family.

As for the penal code, the rules guaranteeing the protection of the family and ensuring respect for all the rights of its members and punishing anyone who infringes on these rights or violating the duties required by it, as the Algerian legislator has arranged within the framework of family relations, have included a set of rights and duties that must be observed in order to ensure the continuation of these relations.

And among these duties is the husband's duty to spend on his family, and this duty is imposed by moral and social reason before it is imposed by Article 37 and Articles 74 to 77 of the Family Law.
