Abstract AR
يهدف هذا البحث إلى تسليط الضوء على تقنية هامة كرسها المنظم الجزائري لتسيير المرافق العمومية لاسيما المحلية منها، من خلال الاعتماد على أسلوب تفويض المرفق العام، وذلك بتحويل بعض المهام غير السيادية التابعة للسلطات العمومية لمدة محددة إلى المفوض له بهدف تحقيق الصالح العام، حماية المال العام، ضمان الجودة والنجاعة في الخدمة العمومية، بفضل الأدوات القانونية الرقابية التي كرسها المرسوم التنفيذي رقم 18/199 لفائدة الجماعات الإقليمية بشكل صريح، حيث تبين لنا من خلال الدراسة إيلاء أهمية بالغة للرقابة على اتفاقيات تفويض المرفق العام للجماعات الإقليمية تراوحت بين الرقابة القبلية والرقابة البعدية، غير أن فعالية أشكال الرقابة وتحقيق الغرض المتوخى منها مرهون بمدى فعالية اللجان المختصة وكفاءة وتأهيل الموظفين المعينين على مستواها، وكذا فعالية وحياد السلطة المفوضة.

Abstract EN
In the last decades the world has witnessed an unprecedented progress in the information and communication technologies field, and this progress has had a prominent impact in various areas of life.
This is because the increase in intellectual production has necessitated a tremendous development in the means of transferring and circulating works, and thus this latter has become a profitable trade place that has been benefited by cloners at the expense of the creators, thanks to the use of technological methods and application that are characterized by accuracy, low costs, ease of use and circulation.
Since digital technology has touched all sectors, the moral rights of the author also has not been spared from this development.

Au cours des dernières décennies, le monde a connu des progrès sans précédent dans le domaine des technologies de l'information et de la communication, et ces progrès ont eu un impact important dans divers domaines de la vie.
Ainsi, l'augmentation de la production intellectuelle a été suivie d'un développement énorme des moyens de transport et de circulation des œuvres, et ainsi ces dernières sont devenues un lieu de commerce rentable dont les cloneurs ont bénéficié au détriment des créateurs, grâce à l'utilisation de méthodes et d'applications technologiques caractérisées par la précision, les faibles coûts, la facilité d'utilisation et la circulation.
La technologie numérique ayant touché tous les secteurs, les droits moraux de l'auteur n'ont pas été épargnés par cette évolution.
