Many countries use systems and mechanisms to protect traders in general, and the commercial companies in the bankruptcy, although these systems vary in terms of development and efficiency, the ultimate purpose being to maintain trade, so assuring the legal safety to attract the investments, and to supply the appropriate legislative environment.

Although the Algerian legislator, created mechanisms to assist the financial situation of the business enterprise, he did not specify relief routes in case of difficulties, so no preventive measures were taken, only corrective measures have been put in place.

It is difficult to find an explanation in this question, because it is necessary to replace the system of bankruptcy of the Algerian commercial law, by a modern system which takes into account the evolutions taking into account current regimes, in the world subjected (submitted) to the legislative competition, and taking into account specificities of the Algerian economy.
