The process of dealing with moral element in environmental crime is originally based on a study of the availability of the wrongdoing-a fact that is not presumptuous- that is, by analyzing the personal and psychological aspect associated with the offender, as required by the requirements of modern criminal policy.

However, given the technical and technical nature of legal protection in the environmental field, criminal responsibility in this area goes beyond the general principles governed by the penal code, since the wrong may be presumed on the part of the offender.

This assumption is found in legislation, and it has its scope in the judiciary, allowing the criminal judge to seek the conclusion of the evidence to establish the moral evidence linking the activity of the debtor to the psychic of the perpetrator.
