أحكام الولاية على أموال القاصر في القانون العراقي و المصري : دراسة مقارنة

Abstract EN

This research deals with the provisions of guardianship over the minor's funds in Iraqi and Egyptian law.

Its purpose is to clarify the similarities and differences between the laws of both countries with respect to the subject of the study, in order to take advantage of the strengths points of each law.

To achieve this, the researcher used the inductive analytical, comparative and critical method.

The study concluded with results: the similarity between the two laws on certain issues; such as non-treatment the conditions of the guardian with clear legal texts, cases of stopping, depriving and restricting guardianship, and the differences in other matters; such as inserting grandfather within the order of guardianships in Egyptian law, while Iraqi law forbade him the guardianship.

The Egyptian legislator has addressed the provisions of guardianship recovery clearly while his Iraqi counterpart neglected them.

Thus, the Iraqi legislature can benefit from the Egyptian legislator, and vice versa.
