Abstract EN

This research tries to highlight on the ideas of one of the greatest writer of the contemporary Islamic world, namely the thinker, philosopher, and cleric, the great Muhammad Baqir al-Sadr in the field of jurisprudence, one of the most important subjects in the field of constitutional law .

The research shows that the thinker Muhammad Baqir al-Sadr was able to formulate an integrated theory in the field of jurisprudence in general and the Islamic state in particular on the basis of pure Islamic, using the ability of jurisprudence to imitate the texts of the Koran, and devising ideas characterized by novelty and origin, From the depth of analysis and accuracy, which characterized by the thought of Mohammed Baqir al-Sadr He wrote in the definition of the state, and the basis of its inception, continued its legitimacy, types, and Islamic state, its functions and objectives, thus being the first Islamic thinker written with such richness, accuracy and depth in analysis We conclude from this research that the thinker Sadr had formulated his views, which we have presented in the field of jurisprudence of the state on the origins of the Koran purely, and to inform him of the theories that tried to explain the formation of the state, through his criticism and rejection of the theories of social contract, and divine mandate, and theories of force and predominance, Family development.

And that Sadr did not adopt in the formulation of his views put forward any sources of jurisprudence, or scientific, had come up with the ideas he mentioned, which we have mentioned in this research
