Abstract EN

This research raises the problem of striking a balance between safeguarding rights and freedoms and the necessities imposed by the executive authorities to deal with the "Covid-19" pandemic.

There is no doubt that providing all the reasons for controlling this pandemic, are necessary measures that governments must take, but these measures may be in light of the exceptional circumstances that are called to override the rights and freedoms guaranteed by the laws.

The research deals with the case study of Algeria as a model, as it became clear that the Algerian state took all necessary measures to face the epidemic, and tried to deal flexibly with the situation in order to safeguard the rights and freedoms of citizens in accordance with the requirements of exceptional circumstances.
