The crime of aggression is one of the most highly debated crimes regarding the definition of its purpose which has necessarily influenced the possibility of its inclusion within the jurisdiction of the Permanent International Criminal Court.

As a result The positions have varied and differed between supporters and opponents, and despite the strong will of the majority of the States in order to criminalize aggression so that the court considers it as a crime this has been overshadowed by the will of the minority and as a consequence of this.

the jurisdiction was postponed by the Rome Statute and suspended until a definition for this crime would be adopted in a subsequent conference.

However, despite the fact that the latter achieved an agreement, it showed at the, same time that the lack of the definition of aggression does not impede the jurisdiction of the International Criminal Court to consider this crime.
