يعتبر موضوع التجارة الإلكترونية من الموضوعات التي أسالت الكثير من الحبر حيث تحتل هذه الأخيرة مكانة رائدة وذلك من خلال الأهمية التي تكتسيها و تطورها المستمر و الدائم بفعل ما أفرزته العولمة من تطورات تكنولوجية حيث أصبح العالم قرية صغيرة قربت المسافات و ألغت الحدود.
لذا أولت التشريعات الدولية اهتماما بالغا بالمعاملات التجارية الالكترونية و الجزائر ليست بمنأى عن كل هذه التغيرات مما يجرنا إلى ضرورة التساؤل حول الإطار القانوني المنظم للتجارة الإلكترونية في الجزائر في ظل المعطيات المتوفرة و مساعي الجزائر للانضمام إلى المنظمة العالمية للتجارة و التي تضع شرط تداول التجارة الإلكترونية من البنود العريضة لشروط الانضمام إليها و كذا المحاولة الجريئة من جانب آخر للمشرع الجزائري من خلال سن قانون التجارة الإلكترونية 18-05 الذي يعتبر قفزة نوعية للدخول إلى هذا المجال الخصب الذي يعتبر أساس الاقتصاد و ما شابه من نقائص تطبيقية اصطدمت بأرض الواقع و معوقات جمة اصطحبت سن هذا القانون و لكن المجال يبقى مفتوحا لتدارك الأمر بسن قوانين مكملة تجعل من هذا القانون ذو فعالية حقيقية
Abstract EN
The theme of e-commerce is one of the topics that have shed a great deal of ink.
The latter occupies a leading position through the importance of its constant and continuous development, as a result of the technological advances of globalization.
The world has become a small village that has brought distances and abolished borders.
Therefore, international legislation has given great attention to electronic commerce transactions, and Algeria is not immune to all these changes, which leads us to question the legal framework governing e-commerce in Algeria.
The available data and Algeria's efforts to join the World Trade Organization (WTO) As well as the bold attempt on the part of the Algerian legislator to enact the e-commerce law 18-05, which is a quantum leap to enter this fertile area, which is the basis of the economy, and the similar shortcomings applied Has come to the ground and many obstacles have taken the age of this law, but the field remains open to rectify the matter by enacting complementary laws that make this law effective.
