The increasing social, economic and political differences between developed and underdeveloped countries, instability and insecurity, pushed the individual to the desire to reach a better life, by resorting to immigration, whether legally or by using illegal means, secret or otherwise, as crossing the border Surreptitiously by contracting gangs specialized in smuggling migrants.

As the latter has become a source of concern facing the security and stability of states, its climax has become evident in what is known as the "crime of smuggling migrants", as it is a transnational crime, as it is a crime of danger as well as continuing crimes because some of its actions that constitute the material pillar take some time to achieve.

And the researcher on this topic, who is familiar with field statistics and media reports, notes the great and surprising spread and proliferation witnessed by this crime, which prompted many countries to strive to combat it, similar to the Algerian legislator who enacted legal texts and special mechanisms aimed at limiting their growth and penalties for their perpetrators.
