الأمم المتحدة منظمة دولية تضم في عضويتها جميع الدول المستقلة في العالم يفترض بها ضمان عدم انتهاك حقوق الأنسان في المجتمع الدولي، إذ وصف ميثاقها بأنه مصدر مهم لكثير من الإعلانات و المواثيق الدولية في زمن السلم و الحرب، بعد أن أكد على ضرورة حفظ السلم و الأمن الدوليين و العمل على حل النزاعات الدولية بالطرق السلمية، إذ يشهد العالم و بخاصة منطقة الشرق الأوسط ازدياد مضطرد في حجم و نوع النزاعات المسلحة التي ألقت بضلالها على واقع حقوق الأنسان، قابله عجز الأمم المتحدة لإيجاد سبل قانونية و سياسية لتفعيل نصوص ميثاقها لإلزام الأطراف المتنازعة بمقررات الإعلانات والمؤتمرات و البروتوكولات الدولية المتعلقة بتجنيب البشرية ويلات الحروب، لذلك يسعى هذا البحث لدراسة طبيعة الصراع في منطقة الشرق الأوسط وبيان حجم الآثار السلبية له و البحث في الأسباب الحقيقية التي تقف خلف عجز الأمم المتحدة في الزام الأطراف المتنازعة لاحترام حقوق الأنسان و سبل تفعيل الوسائل السلمية لحل تلك النزاعات من خلال الأمم المتحدة و مجلس الأمن فيها و إعادة هيبتها في المجتمع الدولي بعد هيمنة بعض القوى على الشرعية الدولية، إذ أستخدم الباحث المنهج التحليلي لتحليل نصوص ميثاق الأمم المتحدة ذات الصلة وما جاءت به المصادر الثانوية كالكتب و المجلات الأكاديمية و البحوث و المقالات المنشورة على شبكة الأنترنت من معلومات حول موضوع البحث، و يأتي ذلك في أطار السعي لدعم نضال الشعوب و لاسيما في منطقة الشرق الأوسط للقضاء على الحرب كوسيلة لحل النزاعات الدولية و ضمان تمتعها عن التدخلات الخارجية و محاسبة مرتكبي الجرائم الدولية، فالأمم المتحدة بشكلها بثرواتها الطبيعية بعيدا الحالي لم تعد قادرة على أدارة الشؤون الدولية بمقارنة دورها في منطقة الشرق الأوسط منذ عام 1990 بعد غزو العراق للكويت و تفكك الاتحاد السوفيتي (السابق(.
English Abstract
The United Nations is an international organization whose membership includes all independent states in the world, which is supposed to ensure that human rights are not violated in the international community, describing its charter as an important source of many international declarations and covenants in peacetime and war, having stressed the need to maintain international peace and security Peaceful resolution of international conflicts, as the world, especially the Middle East, is witnessing a steady increase in the size and type of armed conflicts that have deluded the human rights reality, countered by the inability of the United Nations to find legal and political means to activate the provisions of its Charter to bind the conflicting parties to the above Therefore, this paper seeks to study the nature of the conflict in the Middle East region and to determine the magnitude of its negative effects and to examine the real reasons behind the inability of the United Nations to commit the conflicting parties to respect human rights and ways to activate peaceful means to resolve those conflicts.
Through the United Nations and the Security Council and re-prestige in the international community after the dominance of some forces on international legitimacy, the researcher used the analytical method to analyze the relevant texts of the Charter of the United Nations and what came from secondary sources such as books and magazines This is in the framework of seeking to support the struggle of peoples, especially in the Middle East, to eliminate war as a means of solving international conflicts and ensuring that they enjoy their natural resources away from outside interference and accountability of the perpetrators of international crimes.
The current can no longer manage international affairs by comparing its role in the Middle East since 1990 after Iraqs invasion of Kuwait and the disintegration of the Soviet Union.
