In general, the social insurance reflects a toolkit that aims at compensating the individuals for the damages resulting from social risks, and among the most important types of insurance we find the sickness insurance which is given to all the insured in case of illness; that may lead to cut them off from work.

Therefore, their denial of wages, and the right of compensation.

However, in order to benefit from this right, the insured must be subjected to a medical observation to prove the disease.

Here, we should note the problem, which happens in case the medical opinion comes against to what the insured expects and doesn't prove his incapacity the level that imposes compensation.

This matter may results in a dispute to appeal the medical decision Accordingly, in this research paper, we will focus on two main points: on the one hand, we will get to the sickness insurance as the greatest insured risks, and on the other hand, we will explain the role of the medical expertise as a mechanism of the internal settlement to social security 's dispute in order to prove illness in case of deprivation of the injured to obtain compensation.
