The environment is a vital medium in which human beings and other living organisms live, so we find all international and national legislation both to promote environmental rights, but technological development has produced serious consequences for elements of the environment such as water, air and soil, and caused environmental pollution that affected the human right to a clean and healthy environment, and disrupted the ecosystem as a whole, and therefore legal systems, means and mechanisms have been developed to compensate for environmental damage, which is considered as safeguards to protect the environment.

From degradation and at the same time compensation to those affected, especially if the administration made the mistake, but the environmental damage is characterized by great privacy and therefore the problem of the study is to define this damage and its risks and to determine the legal basis of administrative responsibility for environmental damage? We conclude that environmental damage is of a special nature that requires management to be held administratively responsible either on the basis of error or damage.
