Professional secrecy is one of the most complicated topics due to the complexity of professions in various fields and to its regulation in different legislation in accordance with needs.

The Algerian legislator has tried to regulate the protection of confidential information.

(Undisclosed) due to their importance in accelerating development, and to protect trade secrets through the traditional rules of the Penal Code, the rules relating to the Commercial Practices Act, the Commercial Code as well as the Labour Code, and other laws…Article 301 of the Penal Code is the fundamental point of reference for regulating and addressing professional secrecy, and its general application in the ence of specified texts.

This study aims to analyse this article by analysing the elements of the crime of disclosure of professional secrecy, highlighting the shortcomings and finding solutions in accordance with the requirements of penal policy that it based on the criteria of criminalisation and punishment
