Technological advancement in the field of biomedicine has created a kind of overlap between the techniques that are used in treatment and legal investigation, and fundamental human rights including the right to privacy.

This overlap has aroused a legal controversy about legality of carrying out examinations on human cells as a part of the privacy.

Where, dealing with results of examinations might touch sensitive and dangerous information about health condition and genetic card of human being, which may contradict the special and stable principles in protecting the privacy of the individual.

On the other hand, the olute prohibition of dealing with this information may from a risk to rights of others, as in the case of the examinations for medical necessary, as well as when a genetic testing in necessary in the criminal field for the detection of crimes.
