Competition law restrained and economic regulation the contractual freedom to guarrantee the competition freedom and adjust the economic activity which aiming to achieve regulative and logislative orientation which serves the adjustive,however this restriction is not a holistic restraint but it is a limited and adjustive restriction taken into account legitimacy and disproportion principles under the intervene of specialized entity with mechanisms and flexible technics guarrantees the contractual security and stability through achieving contractual equillibrium and public interest.

La loi sur la concurrence et la régulation économique restreint la liberté contractuelle afin d'assurer la liberté de concurrence et la régulation de l'activité économique visant à mettre en œuvre les directives réglementaires et législatives.

Cependant, serviteur du concept d’état régulateur, cette restriction n'est pas une restriction totale, mais une restriction limitée et régulée.

Celle-ci tient compte des principes de légitimité et de proportionnalité, à travers l'intervention d'organismes spécialisés dotés de mécanismes, et d'une méthode flexible garantissant la sécurité et la stabilité contractuelle par la réalisation des équilibres contractuels et de l'intérêt public.
