Abstract EN

The Palestinian Anti-corruption law convicted any behavior or bribery deeds or embezzlement due to its danger on the economy and development inside the state.

The legislator stated in the public punishments that bribery and embezzlement laws are still valid and without mentioning their range of application or its scope whether by public sector or by criminalization of the private sector and other persons subject to the law and not in public, so we are limited and penalized with impunity.

Therefore, we have raised an important question: How the criminal offenses of bribery and embezzlement in the private sector are subject to the provisions of Palestinian penal legislation.

To provide accordingly a thorough study on this subject, the scientific narrative of analysis, the comparative approach, are used.

The paper concludes that a legislative provision for bribery and embezzlement in the private sector should be set and defined in a manner different from criminalization in the public sector.
