Of the principle of equality and free competition, The legislator also stipulated in the Civil and Administrative Procedures Law 08-09 the urgent appeal as a preventive mechanism that can be activated before the conclusion of the contract in order to secure the greatest possible transparency of the procedures when concluding the deal, and granting the urgent judge extraordinary powers that are unusual in facing the administration and compelling it to comply with the rules of transparency And competition makes it an exceptional measure of great importance to prevent corruption in public procurement.
