Abstract EN

This article aims to study the requirements of the constitutional reform process in Algeria and to clarify the most important paths and determinants of a pattern of the logical relationship between the democratic transition process and the constitutional building in Algeria.

Therefore, the question will be asked about the nature of the relationship between the transition towards democracy and the provision of a constitutional and legal structure appropriate to the nature and level of the desired transformation in Algeria, and how can the new legitimacy of the political system be built in Algeria by overcoming the legal and constitutional imbalances contained in the previous constitutional prescriptions? Some conclusions have been reached, including that the process of building the new legitimacy has a direct relationship to institutional rebuilding and the existence of democratic institutions produced by a consensual constitution that accurately clarifies the relationship between the authorities and the pattern of government.

The levels of responsibilities and authorities must be precisely defined, and it must include rational mechanisms to overcome (institutional deficit) in times of crises, in order to produce functionally effective institutions
