This study came to demonstrate the relevance of the legal rules governing executive seizure on intellectual property rights contained in the Iraqi Implementation Law and the Civil Procedure Law with the special nature of those rights represented in copyright, patent and trademark rights, and then addressing the legislative deficiencies if found in the legal texts regulating this topic In a way that is consistent with the circumstances and changes that characterize intellectual property rights, and the importance of the study is evident in two aspects: the theoretical and the practical.

In theory, the issue of executive seizure of intellectual rights raises many legal assumptions about the compatibility of seizure provisions with the special nature of those rights as well as the practical importance Which may outweigh its theoretical importance, because knowledge of the procedural system for executive seizure requires special procedures that must be known before commencing these procedures.
