Regional conventions devoted human rights and fundamental freedoms of all kinds, collective, individual, civil, political, economic, and social, and established mechanisms to monitor the implementation and respect of the rights enshrined, and individuals fully enjoy these rights without derogation in normal circumstances.

However, if the state was exposed to disturbances and tensions that would shake its entity, the relevant agreements allowed this state to approve a state of emergency restricting the exercise of some rights and freedoms, but this authority granted to states is not olute, but is restricted by a set of guarantees included in those agreements, and accordingly the issue is problematic as follows: What are guarantees for the protection of human rights in cases of emergency, and in order to answer this problem, we divided the topic of our research into two sections.

We devoted the first topic to guarantees of a procedural nature, and the second to objective guarantees.
