إن المشرع الجزائري و بهدف توفير الحماية اللازمة للسائح في مواجهة وكالة السياحة و الأسفار وبغية تحقيق التوازن العقدي بينهما ألقى على عاتق الأخيرة مجموعة من الالتزامات القانونية و انطلاقا من نصوص القانون 99-06 الذي يحكم نشاط وكالات السياحة و الأسفار نجد أن المشرع من خلال نص المادة 21 منه قد ألزم الوكالات السياحة بحسن تنفيذ العقد السياحي باعتبار أن ذلك يشكل أهم ضمانة قانونية يستفيد منها السائح و تهدف هذه الدراسة إلى توضيح مدى كفاية هذه الضمانات التي جاء بها التشريع لأجل حماية السائح المستهلك للخدمات السياحية
Abstract EN
The Algerian legislator, with the aim of providing the necessary protection for the tourist in the face of the tourism and travel agency, and in order to achieve a contractual balance between them, placed on the latter a set of legal obligations in the provisions of Law 99-06, which governs the activity of tourism and travel agencies, we find that the legislator, through the text of Article 21 of it, has obligated tourism agencies to properly implement the tourism contract.
This study aims to clarify the adequacy of these guarantees that the legislation came with in order to protect the tourist consuming tourism services.
