The 2020 constitutional amendment is an important episode in the constitutional reforms initiated by the constitutional founder since the 1996 amendment, which included qualitative additions to ensure and support the independence of the judiciary if it is actually embodied in the field, despite some obstacles that still organically and functionally hamper the independence of the judiciary, such as the appointment of judges, the presidency of the Superior Council of the Magistracy and the influence exerted on him by the President of the Republic, in addition to his exercise of law pardon and the right to reduce and replace penalties.
