Abstract EN

The present study aims to brief on the position of the Algerian legislator about the possibility to take over high responsibilities by persons with dual nationality holding the original Algerian nationality in addition to foreign nationalities, whether original or acquired.

The problem of the study revolves around: to which extent the dual nationals are entitled to assume higher responsibilities in the state? In order to answer this problem, the descriptive approach was adopted to determine the nature of the original nationality and the phenomenon of dual nationality, as well as the analytical approach by analyzing legal texts and facts related to the subject.

The study concluded that the Algerian legislator has limited high responsibilities in the state to people holding the original Algerian nationality, thus the exercise of these positions by persons with dual nationalities is refused except in the case when it's proven that they have renounced the other nationalities they hold
