The role of the judiciary in resolving disputes between the host state's public sector and foreign partner is aimed at determining the legal nature of the public sector-foreign partner contracts, the nature and scope of disputes arising from them, the role and jurisdiction of the national judiciary in resolving such disputes, its ability to balance the interests of the parties to the dispute, the statement of the role of the international judiciary in disputes, the procedural and substantive rules governing the right to litigate before the international judiciary, and the effectiveness of the judiciary in resolving disputes of partnership contracts, basing on the analytical and comparative approaches of the parties to the dispute.

The study highlighted the limited role of the judiciary in disputes between the public sector and foreign partner contracts.
