In Egypt and France, it is legally stated that making international treaties is an act of sovereignty that can by no means be subject to judicial control.

However, there are some relentless attempts to resolve this situation by granting more freedom to such concept.

In this regard, this current study sheds light on the official stages of making international treaties in both Egypt and France, as well as the extent of judiciary oversight by both the Administrative and Constitutional Courts.

In this context, the study will focus on the most important and recent judicial rulings issued in this regard, such as the case of “Tiran and Sanafir “ in Egypt, and the case of “Porta “ in France.

This is added to addressing the new classification of international treaties in the current Egyptian Constitution issued in 2014.
