Abstract EN

This study deals with an important issue, which is the imprisonment of the debtor and the means that can be used to bypass the court’s ruling in respect of him.The study is conducted within the Emirati law (the Federal Civil Procedure Law No.

11 of 1992 and its amendments).

It concludes that there are three cases in which imprisonment can be imposed against the debtor.

Moreover, the study has found that more than one provision addresses the mechanism according to which a party can appeal against the courts’ delivered decision in this regard.

The researcher has assessed the existing regulation and has come up with more than one recommendation to achieve a higher level of justice.
