Judicial mediation is an alternative procedural means to complex, long and costly litigation procedures, aimed at ending the conflict between the adversary parties in whole or in part amicably, mediated by a neutral and independent third party, and was not regulated by the Iraqi legislator, while it was organized by many Arab and Western laws, because of its great importance In alleviating the burdens of the judiciary and judges, by settling the dispute away from the judiciary, with the least time, effort and cost, and in an agreement and consensual manner.

When the parties to the dispute reach a senlement acceptable to both parties.

The role of the judicial mediator comes by drafting the minutes of the settlement agreement, signed by the mediator and the parties to the dispute, and submitted to the court for approval with an attached report signed by the mediator, in which the mediator explains the procedures that have been taken in the mediation.
