وضع نظام براءة الاختراع من أجل تحقيق أهداف اقتصادية على صعيد الاقتصاد الوطني باعتبارها أداة للتطوير التكنولوجي و التنمية الاقتصادية، فيكمن دور براءة الاختراع بالنسبة لمالكها في مجموع الحقوق التي تمنحها له باعتبارها وسيلة لحماية الاختراع، سواءا كانت براءة أصلية أو اضافية التي يودع المالك طلب تسجيلها مع دفع الرسوم، ليتسلم شهادة البراءة من المصلحة المختصة إذا توافرت شروطها الموضوعية و الشكلية.
مما يمنع الغير من التعدي على هذا الحق فأقر المشرع الجزائري حماية براءة الإختراع مدنيا و جنائيا بموجب الأمر 03-07 إلا أنه يبقى هذا التنظيم ناقصا من حيث الكثير من الجوانب، مما يستلزم الرجوع إلى تطبيق القواعد العامة للمسؤولية التقصيرية
Abstract EN
Establishing a patent system in order to achieve economic objectives in the national economy as a tool for technological and economic development, and to receive the patent certificate we need the competent authority to tell if its substantive and formal conditions are met.
In order to prevent others from infringing this right, the Algerian legislator approved the protection of the patent civil and criminal in the law n°03-07, but this regulation remains incomplete subjects in many aspects, which necessitates return to the application of the general rules.
