سعى المشرع الجزائري إلى إيجاد نوع من الاستقرار و الموازنة بين حقوق العمال و مصالح المستخدمين في عقد العمل المحدد المدة الذي يعد استثنائيا، إذ خول للموثق باعتباره قاضي العقود صلاحية إبرامها و ضمان صحتها وفق شروط معينة و في حالات محددة حصرا بالمادة 12 من القانون 90-11، كما عمل على توفير الحماية القانونية اللازمة لها و رتب على مخالفة أحكامها جزاءات مدنية و أخرى جزائية
Abstract EN
The Algerian legislator has worked on making a balance and finding stability between the employees' rights and the employers' interests while setting up a fixed-term employment contract.
The notary is given the authority to draw up these contracts to ensure the legitimacy of its contents according the conditions and the cases provided by the law 11-90.
Furthermore, the Algerian legislation has granted legal protection through provisions enforcing appropriate civil and penal sanctions.
