The right of defence is a right which is legally consecrated via the principle of equality, all citizens are equal before the jurisdictions and it is within reach everyone, however, in terms of administrative litigations.

The representation of the disputing parties is conquilsory before the administrative tribunal and the council of state, by a lawyer, otherwise the lawsuit is not accepted.

As a result, we can say that the state, the wilaya, the local collectivities, the administrative institutions are excluded from the obligation to be represented by a lawyer before the administrative tribunal, and the council of state either in claims proceedings or defence submissions or intervention
