تعتبر حماية البيئة و نزع الملكية غير المباشرة من المواضيع الراهنة و المستحدثة في قانون الاستثمار الدولي.
ففي أولى القضايا المطروحة على المحاكم التحكيمية بخصوص حماية السلطة التنظيمية البيئية للدول المضيفة للاستثمار هناك إجماع شبه كلي على رفض إجراءات حماية البيئة تحت غطاء مفهوم نزع الملكية غير المباشرة و تقدم للمستثمرين تعويضات عنها.
لكن هذه القاعدة بدأت تتلاشى بظهور مجموعة من الاتفاقيات الدولية التي جعلت من حماية البيئة استثناء لنزع الملكية غير المباشرة و لا يستفيد المستثمرون من أية تعويضات عنها.
Abstract EN
Environmental protection and indirect expropriation are among the current and emerging topics in international investment law.
in the first cases before the arbitral tribunals regarding the protection of the environmental regulatory authority of the countries hosting the investment, it is evident that there is an almost total consensus rejecting environmental protection measures under the cover of the concept of indirect expropriation and providing compensation for investors.
however, this rule began to vanish with the emergence of a group of international agreements that made environmental protection an exception to indirect expropriation, and investors do not benefit from any compensation for it.

La protection de l’environnement et l’expropriation indirecte constituent l’une des questions d’actualité introduites en droit international des investissements.
Ainsi, il ressort des premières affaires soumises aux tribunaux d’arbitrage, au sujet de la protection du pouvoir règlementaire environnemental des Etats d’accueil des investissements, un refus quasi unanime des procédures de protection de l’environnement sous couvert de la notion d’expropriation indirecte en contrepartie d’un dédommagement au profit des investisseurs expropriés.
Cependant, cette règle tend à disparaître avec l’apparition d’une panoplie de conventions internationales qui ont fait de la protection de l’environnement une exception à l’expropriation indirecte et en vertu desquelles les investisseurs qui en font l’objet ne bénéficient pas d’une indemnité.
