The digital heritage has become among the most important products of modern technologies that have raised several legal problems, especially those related to their collision and conflict with the deceased person’s right to privacy over his digital assets, which are among the most important forms of images and videos transmitted through social networking sites, as well as via e-mail left by the deceased.

This aroused the ire of legal scholars after several issues were raised in the arena of comparative justice, where there were conflicting opinions between the confirmer and the denial of the right to privacy of the deceased over his digital assets as well as his exclusive ownership of them, so the study seeks to show the features of this conflict, especially in the absence of special legal provisions in Algerian legislation
