epidemic poses a serious threat to public health and the lives of individuals at the global and national levels.

The article aims to discuss the nature of the texts issued by the public authorities in Algeria to confront the epidemic, and to explain the constitutional basis for the measures taken to prevent and combat against its spread.

It is evident from certain provisions restricting individual and collective rights and freedoms that we are facing an unofficially declared health emergency, to fill a void in the health legal system that requires the addition of a new exceptional case in the future.
