In the perspective of Algerian family law, marriage is a consensual contract between a man and a woman in the legal manner required.

Since this contract is a legal act that tends to produce legal effects, it was necessary for both men and women to exchange their consent by entering into it, by explicitly or implicitly expressing their desire to marry.

Consent occupies a very important position, as it is the only element on which the marriage is based on the conclusion of marriage, as well as its failure to nullify such marriage.

Therefore, the association of men with women required them to enjoy in principle the ability to marry and that their consent should be given away from any flaw that may threaten their association with the disappearance.

This study came to examine the validity of consensual consent within the framework of entering into a marriage contract.
