The attribution of 1996 constitution, before its adjustment in 2016, has established the rules of the judicial organization to the ordinary legislator in article 122 and to the organic legislator in article 123.

This constitution put the legislator, the constitutional jurisprudence in the issue of defining the legal nature of the judicial organization rules.

Despite the passage of the organic law on the judicial organization in 2005 and the constitutional amendment of 2016, the issue remains.

The amendment authorized the organic legislator only to make the rules of the judicial system as the organic legislator has preceded the ordinary legislator to the organization of administrative courts with an ordinary law.
