يعد الحق في الحياة الخاصة أو الحق في الخصوصية من أكثر الحقوق تعلقا بالشخصية و أشدها ارتباطا بالكرامة و ذلك لجمعه بين الجوانب المادية و المعنوية لشخصية الإنسان و علاقته الوثيقة بالحقوق و الحريات الأخرى، و يشمل الحق في الحياة الخاصة حرمة المسكن، سرية الاتصالات الخاصة، حماية المعلومات و المعطيات ذات الطابع الشخصي فضلا عن تأثره الشديد بالمخاطر التي فرضها التطور العلمي و التكنولوجي لوسائل الإعلام و الاتصال، خاصة مع صدور القانون 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال المعالجة الآلية للمعطيات و كذا المرسوم الرئاسي 20-05 المتعلق بأمن الأنظمة المعلوماتية اللذان يعتريهما نقص في إقرار الحماية القانونية الفعالة تجاه مختلف أشكال الاعتداء على الحق في الخصوصية الأمر الذي يتطلب ضرورة التدخل التشريعي لسن قانون خاص يكفل حمايته.

The right to privacy or the right to private life is one of the rights most related to personality and most closely related to dignity.
expressing his strong vulnerability to the risks posed by the scientific and technological development of the media and communication, especially with the issuance of law 18-07 relating to the protection of natural persons in the field of automatic data processing as well as presidential decree 20-05 on the security of information systems, which suffers from a lack of effective legal protection against various forms of attacks on the right to privacy, which requires the need for legislative intervention to enact a special law that guarantees its protection.
